Necesidad y Urgencia 70\/2023 de desregulaci\u00f3n econ\u00f3mica, dictado por el Gobierno de Javier Milei, comenz\u00f3 a regir este viernes sin que la Justicia haya dado a\u00fan un curso de manera favorable a reclamos de medidas cautelares que lo suspendan, en el marco de una treintena de amparos presentados por organizaciones sociales y sindicales, abogados constitucionalistas y ciudadanos particulares.<\/p>\n\n\n\n<p>En el fuero en lo<strong>&nbsp;<\/strong>Contencioso Administrativo Federal<strong>&nbsp;<\/strong>de la ciudad de Buenos Aires hab\u00eda hasta el mediod\u00eda del jueves al menos&nbsp;25 amparos&nbsp;y otros dos de la&nbsp;CGT y la CTA ante la justicia del Trabajo, seg\u00fan un relevamiento hecho por T\u00e9lam.<\/p>\n\n\n\n<p>El DNU 70 fue firmado por el presidente&nbsp;Javier Milei&nbsp;e integrantes del Gabinete nacional y publicado en el Bolet\u00edn Oficial el 21 de diciembre \u00faltimo y&nbsp;por Ley entr\u00f3 en vigencia ocho d\u00edas m\u00e1s tarde, es decir, desde este viernes 29, salvo medida cautelar judicial que lo suspenda.<\/p>\n\n\n\n<p>El juez en lo Contencioso Administrativo Federal&nbsp;Esteban Furnari&nbsp;rechaz\u00f3 disponer una precautelar de suspensi\u00f3n de los efectos del DNU en el proceso colectivo iniciado por el Observatorio del Derecho a la Ciudad porque \u00abal d\u00eda de la fecha, las disposiciones del DNU 70\/2023 no han entrado en vigencia (cfr. arts. 5\u00ba y 6\u00ba CCyCN)\u00bb, seg\u00fan la resoluci\u00f3n a la que tuvo acceso T\u00e9lam.<\/p>\n\n\n\n<p>Por su parte, la CGT apel\u00f3 este jueves la decisi\u00f3n del juez nacional del Trabajo Ignacio Ramonet que desestim\u00f3 el dictado de una medida cautelar \u00abinterina\u00bb que suspenda el cap\u00edtulo IV del Decreto vinculado a la reforma laboral porque a\u00fan no entr\u00f3 en vigencia.&nbsp;<\/p>\n\n\n\n<p>El magistrado concedi\u00f3 la apelaci\u00f3n, habilit\u00f3 d\u00edas y horas inh\u00e1biles del 28 y 29 de diciembre y ya&nbsp;gir\u00f3 el expediente a la sala ocho de la C\u00e1mara Nacional de Apelaciones del Trabajo.<\/p>\n\n\n\n<p>En el escrito de apelaci\u00f3n, firmado por H\u00e9ctor Daer, Pablo Moyano, y Carlos Acu\u00f1a,&nbsp;como secretarios generales de la CGT,&nbsp;se advirti\u00f3 que \u00abse trata de conjurar un acto de autoridad que impone una reforma&nbsp;laboral peyorativa sin recurrir al Congreso y que los afecta en los aspectos individuales y colectivos\u00bb, seg\u00fan el texto al que tuvo acceso T\u00e9lam.<\/p>\n\n\n\n<p>Con esta presentaci\u00f3n&nbsp;intervendr\u00e1 por primera vez un&nbsp;Tribunal de Apelaciones en relaci\u00f3n al DNU, aunque s\u00f3lo en lo referido a las normas de \u00edndole laboral.<\/p>\n\n\n\n<p>\u00abDebe tenerse en cuenta, asimismo, que el DNU 70\/23,&nbsp;pretende introducir modificaciones permanentes y no de coyuntura o de emergencia temporal (en derecho individual del trabajo y derecho colectivo)&nbsp;y esta circunstancia es relevante porque no se trata de implementar remedios temporales para una alegada&nbsp;crisis, lo que constituye otro motivo de invalidez ostensible\u00bb, argumentaron los sindicalistas al reclamar una medida cautelar de \u00abno innovar\u00bb y la suspensi\u00f3n de la puesta en vigencia del T\u00edtulo IV del DNU
