La decisi\u00f3n fue tomada por el Juzgado Federal en lo Civil, Comercial y Contencioso Administrativo de San Mart\u00edn N\u00b0 2, que hizo lugar a una\u00a0<strong>cautelar\u00a0<\/strong>que hab\u00eda presentado el Sindicato de Empleados de Vialidad Nacional (<strong>Sevina<\/strong>), uno de los gremios del sector.<\/p>\n\n\n\n<p>El fallo, lleva la firma de la jueza federal\u00a0<strong>Martina Isabel Forns<\/strong>. <\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"1080\" height=\"1080\" src=\"https:\/\/infoecos.com.ar\/wp-content\/uploads\/2025\/02\/image-171.png\" alt=\"\" class=\"wp-image-137747\" style=\"width:492px;height:auto\" srcset=\"https:\/\/infoecos.com.ar\/wp-content\/uploads\/2025\/02\/image-171.png 1080w, https:\/\/infoecos.com.ar\/wp-content\/uploads\/2025\/02\/image-171-800x800.png 800w, https:\/\/infoecos.com.ar\/wp-content\/uploads\/2025\/02\/image-171-768x768.png 768w, https:\/\/infoecos.com.ar\/wp-content\/uploads\/2025\/02\/image-171-1024x1024.png 1024w\" sizes=\"(max-width: 1080px) 100vw, 1080px\" \/><\/figure>\n\n\n\n<p>El Poder Ejecutivo debe\u00a0abstenerse de ejecutar\u00a0cualquier acto administrativo que derive del\u00a0Decreto 461\/2025, entre ellos\u00a0reubicaciones, traslados, cesant\u00edas, suspensiones, pases a disponibilidad de personal o supresi\u00f3n de estructuras\u00a0vinculadas a la\u00a0Direcci\u00f3n Nacional de Vialidad.<strong>\u00a0<\/strong>Esto por el t\u00e9rmino de<strong>\u00a0seis meses.<\/strong><\/p>\n\n\n\n<p>Entre sus justificativos, se bas\u00f3 en las condiciones de trabajo que rigen para los trabajadores de la Direcci\u00f3n Nacional de Vialidad, en el principio de irrenunciabilidad de derechos consagrados para sus empleados y, sobre eso, acot\u00f3: \u201cLa Constituci\u00f3n Nacional, como los convenios de la Organizaci\u00f3n Internacional del Trabajo (OIT) con jerarqu\u00eda constitucional,&nbsp;<strong>impiden al Estado en su rol concurrente de empleador y regulador alterar de manera unilateral condiciones de trabajo que han sido establecidas por norma colectiva con plena vigencia<\/strong>\u201d.<\/p>\n\n\n\n<p>La magistrada tambi\u00e9n dijo que en el&nbsp;<strong>art\u00edculo 32&nbsp;<\/strong>del Decreto 461\/2025 de Milei se dispone que la estabilidad del personal tiene \u201cuna fecha de vencimiento\u201d, por lo que plante\u00f3:&nbsp;<strong>\u201cSe vulneran las normas y garant\u00edas laborales vigentes\u201d.<\/strong><\/p>\n\n\n\n<p>Asimismo, consider\u00f3 que la decisi\u00f3n de que todo movimiento de trabajadores deber\u00e1 contar con la aprobaci\u00f3n previa del Ministerio de Desregulaci\u00f3n, que conduce&nbsp;<strong>Federico Sturzenegger<\/strong>, \u201cconlleva la subordinaci\u00f3n de las decisiones a la&nbsp;<strong>exclusiva discrecionalidad<\/strong>\u201d de esa cartera. \u201cDicha disposici\u00f3n vulnera de forma manifiesta el principio de estabilidad, as\u00ed como los derechos laborales y sindicales reconocidos a los trabajadores estatales\u201d, dijo Forns en el fallo, que ancl\u00f3 tambi\u00e9n&nbsp;<strong>en la libertad sindical, la negociaci\u00f3n colectiva y la protecci\u00f3n del empleo p\u00fablico \u201cfrente a injerencias indebidas por parte del Estado empleador\u201d.<\/strong><\/p>\n\n\n\n<p>En sus planteos, la magistrada habl\u00f3 de los trabajadores como un sector&nbsp;<strong>\u201csocialmente vulnerable\u201d<\/strong>&nbsp;e hizo lugar a los reclamos por la \u201cposible vulneraci\u00f3n de derechos de naturaleza alimentaria\u201d derivados de \u201ceventuales despidos masivos o modificaciones unilaterales en las condiciones laborales\u201d.<\/p>\n\n\n\n<p>Por eso, determin\u00f3: \u201cEsta etapa preliminar del proceso, donde se verifican&nbsp;<strong>circunstancias graves y objetivas<\/strong>, permite justificar el&nbsp;<strong>dictado de una medida cautelar de no innovar,<\/strong>&nbsp;a fin de&nbsp;<strong>evitar perjuicios irreparables y preservar el statu quo hasta tanto se resuelva la cuesti\u00f3n de fondo\u00bb.<\/strong><\/p>\n\n\n\n<p>Mientras tanto, no hizo lugar a la nulidad e inconstitucionalidad del decreto, ya que consider\u00f3 que eso requiere un estudio \u201cm\u00e1s complejo y profundo\u201d.<\/p>\n\n\n\n<p><strong>Fuente: lanacion.com.ar (p\u00e1gina online del diario La Naci\u00f3n).
